The history of the UK system of compensation claims for personal injury is an adversarial one. There is an atmosphere still of mistrust between some claimant lawyers and some insurers which continues to get in the way of effective claims handling. There are issues of inexperience and lack of training on both sides.
The advent of the Civil Procedure Rules has not made the widespread impact in this regard that was expected.
