23 July 2008: Press release - BICMA’s President slams Ministry of Justice
Norman Cottington, the President of the Bodily Injury Claims Management Association, today heavily criticized the recently-published proposals from the Ministry of Justice on reform of the claims process.
He was shocked to see that no mention had been made in the document of the need to ensure that injured claimants receive rehabilitation treatment at the earliest stage of the claims process.
He said “For the last 10 or more years rehabilitation of accident victims has been an integral part of the claims process in personal injury claims, supported by insurers and claimants’ solicitors alike. It is wholly unacceptable that this vital issue has been completely ignored by the MoJ in their recent paper.
“I call upon the Minister responsible to issue a statement immediately, confirming that his Ministry continues to support rehabilitation in PI claims and that this will form part of any new claims process”
This sentiment has been echoed by other stakeholders, including Motor Accident solicitors Society (MASS) and the Association of Personal Injury Lawyers (APIL).
Note: the need to address rehabilitation was written into the Civil Procedure Rules in 2005 and is therefore a mandatory issue to be addressed in all PI claims.
